Workshop terms and conditions
We, Gedime Motors Ltd (hereinafter called The Company) accept vehicles (as hereinafter defined) for repair, for examination with a view to estimating for repairs, for garaging or pending sale or for any other purpose, only on and subject to the following terms and conditions (in addition to any conditions stated on the face hereof): -
1. Estimates are effective only for 28 days after issue. If instructions are not received from a customer (in response to an estimate rendered) within 7 days from issue of the estimate, the Company may charge its usual garage rates at 10 a day from the date the vehicle was received until its collection. (Note: - The Company does not as a general rule make any such charge for garaging pending instructions. If the repairs are ultimately carried out by the Company and duly paid for.)
2. Any work done or goods supplied in relation to a vehicle, by the order of any driver in the Customer's employ, or by any person who is reasonable believed to be acting as the Customer's agent, or by the order of any person to whom the company is entitled to make delivery of the vehicle, shall be paid for by the Customer.
3. Payment for all repairs and/ or spare parts supplied is due on completion of work, but the Company may demand a deposit before commencing or in the course of any work. A repair is completed for the purpose of these conditions when notice has been given that the vehicle is ready for collection.
4. The Company shall have a general lien on a vehicle and all its contents for all the monies owing to the Company by the Customer on any account whatsoever. The Company shall be entitled to charge garage rent £25 a day during any period in which the vehicle is retained by the virtue of the lien.
5. In connection with any inspection, testing, repair, or contemplated repair, or other purposes for which a vehicle is accepted by the Company, the Customer is deemed to have authorized the driving of the vehicle by the Company
6. The Customer shall be entitled to the benefit of any warranty to which the Company is entitled as against the manufacturer of parts and materials supplied or any sub- contractor. All work carried out by the Company is warranted against failure due to defective work for a period of three months / 2,000 kms whichever occurs the first. This warranty extends only to repairs actually undertaken and does not cover progressive fault diagnosis, it does not affect any statutory rights.
7. All parts removed by the Company in the course of repair shall, if not claimed by the Customer when taking delivery of the vehicle be deemed to be wholly abandoned to the Company and they shall become the Company's absolute property accordingly.
8. Any notice to the Customer posted to his last known address shall be good notice.
9. If a vehicle is not collected, and the Company charges are not paid within 24 hours after work completion, the Company may charge its current storage rent at £25 a day.
10. In accordance to EU Directive 95/46/EC on Data Protection, you consent to have your personal data stored on the files of GEDIME MOTORS LTD., Mercedes-Benz España, S.A.U. and Daimler AG for the provision of contracted services between parties and also for information about products and services in the automotive, finance and insurance sectors marketed by the Daimler Group of companies in Spain to be sent to you even by electronic means.
It is agreed that your data may be transferred to companies of the Official Mercedes-Benz network and the rest of Daimler Group of companies in Spain, listed on www.mercedes-benz.es , and used by them for carrying out promotional activities of products and services by Mercedes-Benz even by electronic means. It is also authorised that your data be used by companies within the Daimler Group in Spain to share information with Mercedes-Benz España S.A.U., of which you are already a client, of contracted products so that they may action promotional activities even by electronic means, and also for statistical and risk assessment purposes.
You confirm to be informed about your rights of access, amendment, cancelation and objection that you may exercise in writing, to GEDIME MOTORS LTD. at 72 Devil’s Tower Road, Gibraltar to the attention of the Marketing Department, or to Mercedes-Benz España, S.A.U. Sector de Marketing, Avda. de Bruselas, 30 - 28108 Alcobendas (Madrid), Spain, or to Daimler AG HPC 0624 D-70546 Stuttgart, Germany.
CONTRACTUAL DIGITAL SIGNATURE & AMENDMENTS A digital signature will activate this contract and any amendments to it and for all intent and purposes shall have the exact same validity as a physical signature.
NOTICE
Customers are strongly advised to remove all items of value not connected with the vehicle when leaving it on the Company's premises since the Company cannot accept liability for any loss or damage to the same.
